How Long Do I Have To Wait To File For An Expungement In Michigan?

You must wait at least five years from the full resolution of your case.

What Convictions Cannot Be Expunged in Michigan?

Convictions for the following offenses cannot be expunged in Michigan:

  • Child sexual abuse or possessing or distributing child sexually abusive material.
  • Using or attempting to use a computer to solicit a minor.
  • Completion or Attempt of first, second, or third-degree sexual misconduct. MCL 750.520b-d
  • Violation or attempted violation of assault with intent to commit penetration.
  • Violation or attempted violation of second- degree child abuse.
  • A violation or attempted violation of child abuse in the presence of another child.
  • Traffic offenses, including driving under the influence.
  • A felony conviction for domestic violence if you have a previous conviction of domestic violence.
  • Human trafficking, MCL 750.462A to 750.462J and 750.543A to 750.543Z.
  • Felonies punishable by life in prison even if your actual sentence is shorter.
  • Fourth degree criminal sexual misconduct on or before 1/12/15.

How Much Does It Cost To File An Expungement Petition in Michigan?

It costs $0 to file an expungement petition. However, there are minor fees you will incur such as a $50 Michigan police report background check fee. The miscellaneous fees are about $100. There will be additional costs if you wish to retain an attorney.
